SC ORIEL BEER & MORE SRL is a Romanian legal entity with headquarters in Bucharest, Drumul Gura Calitei Street, number 34 – 38, District 3, having an order number in the Trade Register J40 / 13486/2015 and unique registration code RO35195622, telephone number +40742 354 585, hereinafter referred to as www.orielbeer.com.

By accessing the www.orielbeer.com site, all users expressly agree to abide by all of the terms and conditions set forth below, as well as the applicable laws, including the terms and conditions of the Privacy Policy and Cookies, which are detailed below .

DEFINITIONS AND TERMS

www.orielbeer.com will also be referred to as the “Seller”
Any person accessing the www.orielbeer.com site and registering in a valid manner, communicating www.orielbeer.com with all necessary data, will be referred to as the “User”.
Any person over the age of 18 and making an account on the Site and placing an order will be referred to as the “Buyer or Customer”.
The online store hosted by www.orielbeer.com is named “Site”.
“My Cart” is the section of the Account that allows the Purchaser / User to add items he / she wants to purchase at the time of adding or at a later time.
“Order” is the electronic document that acts as a form of communication between Seller and Buyer through which the Buyer submits to the Seller through the Site its intention to purchase articles on the Site.
By placing an order on the site, the User expressly agrees with any form of communication through which www.orielbeer.com will carry out its operations (by phone, email).
“Items or Products” means any item or product loaded on the online store’s mailing page, with the indication that in certain situations, there may be differences between the actual product and the one in the photograph.

GENERAL CONDITIONS

Using the www.orielbeer.com site (browsing, placing orders, processing personal data) implies the warranty on the part of the User or the Purchaser that he or she has reached the age of 18.
The Site Administrator www.orielbeer.com reserves the right to change the content of the site and online store products at any time without prior notice.
By browsing the site, the User or Purchaser is solely responsible for all the activities resulting from its use (placement of orders, payment in cash or online payment with the card, the online store being engaged only in the delivery of the confirmed and paid orders.
If for justified reasons the Seller reserves the right to change the quantity of the Products in the Order, it will notify the Buyer at the e-mail address or the telephone number made available to the Seller upon making the Order and will refund the amount paid.
The object of the agreement is the sale of products ordered on the site by the Buyer and confirmed for delivery of online store agents.
The Seller and Buyer Agreement is considered to be terminated only when the Purchaser receives the order and the Seller the amount of the payment representing the equivalent of the order.
The buyer has the right to pick up the order from the Seller’s premises.

ONLINE SELLING POLICY AND PAYMENT WAYS

The product sale price is the price displayed on the site in the online store section. The displayed price includes VAT and is in RON. The sale price can be changed at any time by www.orielbeer.com without prior notice.
When ordering is confirmed, the online store will issue a tax invoice / receipt for the products to be delivered, the Buyer being required to provide all the personal data required for its preparation.
www.orielbeer.com undertakes to honor all orders received, except for rare situations (out of stock products, exceptional cases of late delivery by the courier, etc.)
Only buyers over the age of 18 have the opportunity to purchase alcoholic beverages (beer), and if the Seller finds at any time that the person who placed the order is not at legal age, he has the right to cancel the order.
The buyer has the option of choosing the payment method by selecting: Payment in cash in the case of delivery with a courier company, Buyer will hand over the cash order to the courier agent on a receipt note or Payment online with bank card, secure processing mediated by Netopia Mobil Pay, commission 0%, directly on site.
Promotions are only available within the limit of the stock available during the times and conditions indicated on the site.

PRODUCT DELIVERY

Delivery of the orders will be made at the address indicated by the Buyer, within 14 days of the time the product was taken by the courier company with which www.orielbeer.com has a contract. The Buyer has the obligation to provide all the information required for delivery (Full Name, Address, Phone Number), otherwise the Seller has the right to refuse the order. The payment of the order’s shipping is the Buyer’s charge, except when are promotions that the Seller displays or communicates in advance.

The buyer has the opportunity to pick up the order from the Seller’s office as well, but with an advance confirmirmation of day and time of delivery with the Seller. The goods ordered can be picked up from ORIEL BEER, from Drumul Gura Calitei street, number 34-38 (entrance from Drumul Gura Ariesului Street, number 30-40), District 3, Bucharest.

Deliveries are made on the territory of Romania and some European Union countries.
If the maximum delivery time is not met, the Seller will notify the Buyer of the estimated delivery time.
www.orielbeer.com does not take responsibility for the delays caused by the courier company.
If delivery is not possible due to the Buyer, it will handle the shipping costs if it will ask for the delivery again.

CANCELLATION AND RETURN POLICY

The Seller has the right to cancel the Buyer’s order if the online payment with the card is rejected and invalidated by the payment processor, or the data provided by the Buyer is incorrect or incomplete.

The buyer has the right to cancel the placed order or to return the ordered products without invoking any reason and without incurring any costs other than the return delivery. Buyer has the right to return the ordered products within maximum 14 days, according to GEO No. 34/2014. The buyer has the obligation to send the products in their original form without being damaged and with the intact labels.

If the order is returned, the Buyer may request the change of the measures for the inappropriate products in size, but he will also bear the transportation costs.
For returned products that show signs of scratches (scratched or broken bottles, traces on labels, worn clothing items), www.orielbeer.com has the right to choose whether to accept returning the full value of the order you have paid. In this case the Seller has the right to decrease the amount returned to the Buyer.
In the event of exercising the legal right to return the placed order, www.orielbeer.com will refund its bank transfer fee within 14 days of receipt of the return.
Buyer has the obligation to request the return and fill in the bank account details to make the refund possible.

CONFIDENTIALITY AND PROCESSING OF PERSONAL DATA

www.orielbeer.com undertakes to keep the confidentiality of any kind of information that the Buyer chooses to provide.

The Buyer undertakes not to provide any public statements to third parties without the Seller’s consent, and Seller undertakes not to provide any confidential information to third parties other than those directly involved in the ordering process.

www.orielbeer.com undertakes to make every effort to process personal data in accordance with Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”) and the legislation of the country .

Partners who will have access to Buyer data are: courier company with which www.orielbeer.com has a contract (CARGUS or any other parcel delivery company), payment processor (Netopia Mobilpay), Google Analytics.

The User / Buyer, by declaring consent to personal data processing activities, also has the right to refuse to use and delete them, has the right to unsubscribe from the newsletter and any other promotional information received and to have access to personal data used by www.orielbeer.com.
